Event Terms and Conditions – Paleo Weekend 11th/12th– 13th May

TERMS AND CONDITIONS

Please read these Terms and Conditions, they form the basis of the Contract between you and Paleo.com.au.

Training & workshops carry inherent risks, and if you are concerned about participating in our event, please contact us prior to booking.

1. Reservations, Deposits and Other Methods of Payment

This contract is in effect when initial payment is received.  When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. We also do not accept deposits, cheques, cash, delayed payments, barter or grant discounts. Payments must be made exclusively through Eventbee/Paypal.

2. Payment and Refund Policy

Cancellation and early departure: Any cancellation or early departure by you during the course, or any limited use of our facilities or activities included in the cost of the course will not entitle you to a refund.  Payments are non-refundable after 4 weeks prior to the event, except in the event of death or serious illness as documented by a physician.  Cancellations made 4-8 weeks before the course will receive a 50% refund. Cancellations 8 weeks or more before the course will receive a full refund minus a AUD 150 booking fee.  Refunds for weather conditions will not be given.

3. Modifications by paleo.com.au

It is unlikely that we will have to make changes to the event, but we do plan the arrangements many weeks in advance.  Occasionally, we may have to make changes and we reserve the right to do so at any time. We may modify the list of sessions and facilities (e.g. equipment and services) included in the workshop, the teachers and presenters, together with the time & dates of opening and closure of the event. 

4. Cancellation by paleo.com.au

We reserve the right to cancel your course in any circumstance up to 1 week before the start date. For example, if the minimum number of attendees required for the course is not reached, we may have to cancel it.  In this event we will inform you as soon as practical and you will have the choice of having a full refund of all monies paid or accepting an offer of an alternative course, if available.  We will not cancel your course within 1 week of the start date unless either compelled to do so by reasons of force majeure.  If any teachers or presenters are unable to provide training for a session, another qualified professional will instruct the session in lieu of. 

In the unlikely event of cancellation of the Paleo Weekend and regardless of reason for cancellation, paleo.com.au will not be held responsible for any costs, damages, or other expenses of any kind, including, without limitation, transportation and/or hotel costs incurred by registrant. Speakers subject to change without notice.

 5. Liability

Paleo.com.au does not accept liability or pay you compensation where the performance of our contractual obligations is prevented or affected by ‘force majeure’.  This means that we will not pay you compensation if we have to cancel or change your event in any way because of unusual or unforeseeable circumstances beyond our control.

In these booking conditions ‘force majeure’ will include (but shall not be limited to) war, threat of war, riot, civil or political unrest, industrial dispute, terrorist activity threatened or actual in its consequences, natural or nuclear disasters, fire, adverse weather conditions, closure of ports or airports, air traffic control delays, technical problems of transport or other circumstances amounting to force majeure.

6. Valuables

Paleo.com.au strongly recommends that you leave valuables at home and takes no responsibility in case of loss or theft.  The accommodations are camp / tent style and do not lock.

7. Complaints and arbitration

Paleo.com.au takes your satisfaction very seriously and strives to give you an excellent experience. If you have a problem during your course, you are obliged to inform our staff immediately who will endeavor to correct the issue immediately.  If your complaint is not resolved during your stay, please follow this up in writing within 28 days of completion of the event.

You must communicate any complaint to our staff without delay.  If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint while you were on the island and this may affect your rights under this contract.

8.  Waiver.  All attendees will be required to sign a waiver at the start of the course, similar to that shown below

PALEO WEEKEND WAIVER OF LIABILITY/RELEASE OF CLAIMS

A. The undersigned (“Participant”) acknowledges that while at the Paleo 2-3 day conference event (“Event”), Participant may or will be participating in fitness, sporting and recreational activities such as group workouts, running lessons, yoga, hikes, harbour swims and other activities (collectively, “Event Activities”). Participant understands that many of these Event Activities (including the combination of all such Event Activities) may involve a high degree of risk of injury, including serious injury or death. Participant acknowledges that he or she has been advised to be evaluated by his physician prior to participating in Event Activities and participating in the Event and that Participant has been so evaluated or has voluntarily elected not to be evaluated. Participant also acknowledges that coaches, trainers, therapists, and other conference staff members (collectively, “Staff”) may be at the Event and may treat or advise Event participants for or on injuries, engage in massage and other therapy, engage in or advise on stretching exercises or general conditioning (collectively, “Treatment”). Participant shall have no obligation to seek Treatment from or use any Staff members. However, if Participant elects to seek Treatment from or use any Staff members, then Participant agrees that he or she is doing so voluntarily and at his or her own risk. Event organizers do not make any representations or warranties regarding any Treatment, judgment or activities of any Staff nor their professional qualifications.

 B. Participant further acknowledges and agrees that Paleo Australia, Paleo.com.au, Cockatoo Island, the Harbour Trust, and other organizers, directors, contractors, and caterers of the Event, and all owners, officers, directors, members, partners, employees, agents, heirs and representatives of the foregoing (collectively, “Personnel”) will not be responsible or liable, in any manner, for any injuries, claims, liabilities or damages of any kind which are sustained, suffered or incurred by Participant as a result of his or her participation in Event Activities or in the Event, as a result of his or her attendance at Event or as a result of any Treatment performed by any Staff. In consideration of the Participant's voluntary participation in the Event and any Treatment by any Staff, the undersigned, on behalf of himself or herself and his or her heirs, executors, distributees, legal representatives, administrators and assigns, hereby releases, waives, discharges and relinquishes all Personnel and all Staff from and against any and all claims, damages, liabilities, injuries, losses, costs, expenses, actions and causes of action which may hereafter arise for or be suffered or incurred by Participant or Participant's estate as a result of Participant's participation in Event Activities or in the Event or the negligence of any Event Personnel or Staff, to the extent permitted by law, any other acts of any Event Personnel or as a result of any Treatment performed by any Staff and agrees that under no circumstances will Participant or Participant’s heirs, executors, distributees, legal representatives, administrators or assigns prosecute or present any claim or lawsuit for personal injury, property damage or otherwise against any Personnel.

 C. Participant acknowledges that photography and video film may be shot during the Event. Participant consents to the use of his likeness/performance in whole or in part on film, videotape, in digital images or in any other media (collectively, “Images”). Participant agrees that he has no right, title or interest of any kind in or to the Images and that the Images may be used by any Personnel for any private, promotional or commercial use without compensation or notice to Participant and Participant hereby authorizes such use.

 D. Participant acknowledges and agrees that he/she will be solely liable for any and all injuries or damages of any kind or nature, sustained, suffered or incurred by any other person as a result of Participant’s participation in Event Activities and/or Participant’s conduct or actions at Event, whether intentional or otherwise, or whether resulting from the negligence or other acts of any Personnel or Staff, to the extent permitted by law, any other acts of any Event Personnel. Participant agrees to and shall indemnify, defend, reimburse and hold harmless all Personnel and Staff from and against any and all claims, damages, liabilities, injuries, losses, costs, expenses (including reasonable attorneys' fees and costs), actions and causes of action (including, without limitation, personal injuries and property damage) suffered or incurred by Personnel or others as a result or arising out of or in connection with Participant's participation in Event Activities and/or Participant's conduct or actions at Event or as a result of any Treatment performed by any Staff. The undersigned acknowledges that he or she has read the foregoing paragraphs, has been informed of the risks faced by Participant as a result of Participant's participation in the Event or as a result of any Treatment performed by any Staff, and has voluntarily signed this Waiver of Liability/Release of Claims with full knowledge of the legal consequences of doing so. Participant represents that he or she has no physical limitations, injuries or conditions that would prevent, limit or otherwise affect his or her participation in any Event Activities.
